In the ongoing case known as The Stealing of Emily, serious concerns continue to emerge regarding the whereabouts and welfare of Emily Newbold-Smith. Despite multiple complaints submitted to the Southern Health and Social Care Trust and the Northern Ireland Commissioner for Children and Young People (NICCY), no agency has been able to provide verifiable evidence confirming that Emily is even in Northern Ireland. A recent Freedom of Information (FOI) request to the Department of Health (reference: DOH/2025-0122) seeks critical documentation from 1 May 2023 to the present. However, the situation has been further complicated by correspondence suggesting that the Department of Education believes Emily may be located in Tonbridge, Kent—not Northern Ireland. This discrepancy highlights the alarming lack of clarity, oversight, and accountability surrounding Emily’s case, and raises urgent questions about inter-agency communication, data protection, and the legal basis for her placement. Furthermore there has been nothing forthcoming from IBAC or OVIC and Dunkley’s crimes.

Dear Ms. Gildernew,
Thank you for your letter dated 24th May 2025 acknowledging receipt of my Freedom of Information request regarding documents related to Emily Newbold-Smith for the period from 1 May 2023 to the present. I appreciate your confirmation that the request is being processed under the Freedom of Information Act 2000, and note that the assigned reference is DOH/2025-0122.
Please confirm whether the Department holds the requested material directly, or if it will be necessary to consult with external bodies, such as the Southern Health and Social Care Trust or Newry Social Services, to identify and collate any relevant documentation.
I would also like to raise a serious point of concern: as you may be aware, it is not certain that my daughter is currently in Northern Ireland. Despite two separate complaints—one with the Southern Health and Social Care Trust and another with NICCY—neither process produced any verifiable evidence confirming her presence in Northern Ireland during the relevant period. Furthermore, I have reason to believe that the Department of Education (DoE) considers her to be located in Tonbridge, Kent, according to recent correspondence. This inconsistency raises questions about jurisdiction, oversight, and the accuracy of records being relied upon by the Department and associated agencies.
If a fee is to be applied in processing this request, I would appreciate advance notice and a breakdown of any charges, as outlined in your procedures.
I look forward to your full response within the statutory 20 working days as required by the FOIA. I caution you this information may be provided as part of a court claim. Failure to provide evidential information may bring down the full force of the law upon you.
