Subject: Subject Access Request—Introduction Reference 50239746-2024

Dear Data Protection Officer,

Thank you for acknowledging my Data Protection request on Jan 30th, something neither Nicky nor Southern Health and Social Care Trust have achieved to date.

For clarification, I would like to ask what input the information office in the Northern Ireland Information Office will have in this request.

For additional information, can you clarify what aspects of the Care Act were investigated by the Office of the Police Ombudsman for Northern Ireland when the matter was investigating the police, the Social Care Trust, and NICCY? As you seem to have made this paramount in your investigation to contact Social Services concerning my missing daughter, who your team has not even identified as living and thriving in Northern Ireland. Any other contact with my information would be a potential data breach. It is clear to me then you should have considered the non-jurisdictional matters of judges in family courts the weight of paternity DNA sample evidence showing clear family traits and this blatant breach constitutes serious negligence and a violation of her rights (Children Act 1989, Section 22C(9)(b); Children (Northern Ireland) Order 1995, Article 27).

Specifically, my daughter’s NHS records incorrectly list the name “Keenan,” despite Gerard Keenan not being her biological father and no biological relationship existing between her, her stepsister, or the Keenan family. Additionally, her most recent birth certificate confirms that she was not adopted.

I have submitted DNA evidence (reference: SA010831060GB) that confirms no connection between my genetic background and Irish genealogy. This discrepancy in her records may constitute a breach of GDPR, and I request immediate correction of any erroneous data.

Furthermore, I requested information regarding a paternity test previously arranged through your office. Specifically, I ask for the percentages of countries of origin for:

1. Emily Cathryn Newbold Smith (DOB: 30/10/████, NHS Number: ███ ███ ████)
2. Lauren Juliet Peters (DOB: 30/04/████, NHS Number: ███ ███ ████)
3. Their mother, Catherine Louise Smith  (DOB: 30/05/████, NHS Number: ███ ███ ████ – DECEASED)
4. David Cunningham believed to be the father of Lauren.

As per the Freedom of Information Act 2000 (FOIA) and the Equality Act 2010, I expect this information to be provided promptly. If any exemptions apply, I request that personal details be redacted accordingly, while ensuring compliance with legal obligations to confirm or deny the existence of such information.

I also wish to remind you of your duty to handle all sensitive data in compliance with GDPR and related legal frameworks. It is crucial that my daughter’s records are amended to reflect accurate and lawful information.
