18th November 2024

On 18th November 2024 a writ of The Children Act 1989 and alleged breaches of Articles 6, 8, and 14 of the Human Rights Act, alongside breaches of Estoppel was served on East Sussex (ESCC) and ECHR Strasbourg Court under their reference .4944 and not 4943

The applicant, Mr. Martin Peter Newbold, has filed an urgent appeal to the European Court of Human Rights (ECHR) alleging violations of Articles 6, 8, and 14 of the Human Rights Act, as well as breaches of Estoppel. His request stems from a long-standing legal battle involving East Sussex County Council and the Information Commissioner’s Office (ICO), where the family contends that their rights and agreements have been ignored by local authorities. Mr. Newbold is seeking the immediate return of his child, Emily, who he believes is in imminent danger due to the failure of social services and the courts to ensure her safety. He has requested the issuance of a Writ of Attachment and Writ of Habeas Corpus to compel the return of his child and to ensure her medical, forensic, and safeguarding needs are addressed.

The case has a history of delays and unresolved issues, including the failure of East Sussex County Council to honor previous court orders regarding contact with his child, as well as ongoing systemic failures within the family justice and child protection systems. The familyโ€™s attempts to address these issues through various organizations, such as NIDirect and Capita, were hindered by bureaucratic and legal obstacles, and Mr. Newbold argues that the complaints were handled negligently. The applicant contends that these delays and failures are part of a broader pattern of systemic issues that reflect a disregard for human rights and legal obligations, particularly in cases involving vulnerable children.

Mr. Newbold also emphasizes the financial difficulties faced by East Sussex County Council, which is facing a significant budget deficit, and argues that these financial pressures have exacerbated the failure to provide adequate care and services. He claims that these failures violate the principle of Estoppel, which prevents the council from ignoring its prior commitments, and that the council’s inaction has caused significant harm to his family. Additionally, he raises concerns about the closure of his cases by the ECHR, urging a reconsideration of the decisions and a more thorough investigation into the systemic failures in the child protection and family justice systems. He points to his own experience as a Litigant in Person and asserts that his family’s treatment constitutes a violation of their human rights under the Act.

The applicantโ€™s concerns are supported by the findings of the Truth Commission, which further highlight the systemic issues he has faced. Mr. Newbold concludes by requesting that the European Court of Human Rights reconsider the closure of his cases, conduct a thorough review of the issues raised, and ensure that justice is served in his case and others like it.

Subject: Data Protection Request โ€“ Security Footage and Transcript of November 15, 2024 Event

Dear HL Communications Team,

I am submitting a formal Data Protection request regarding the security footage and any associated records for the Children and Families Truth Commission Report Launch held in the House of Lords on November 15, 2024.

Your previous determination that this was an external event seems questionable, as you informed me via telephone today that external rooms within the House of Lords do not have security footage. This would present a significant security risk for members meeting in such spaces. Additionally, Baroness Tanni Grey-Thompson was reportedly involved as chair. While there appears to be no official record of a House of Lords meeting chaired by her on this date, on Hansard, your response implies the meeting did not occur.

Can you please confirm the occurrence of this event and provide:

  1. Full references to any records relating to the event.
  2. Full security recording of this meeting   Children and Families Truth Commission Report Launch held in the House of Lords on November 15, 2024
  3. A transcript of the event   Children and Families Truth Commission Report Launch held in the House of Lords on November 15, 2024 or a clear statement as to why such a public record is not available.
  4. A clear response if this security footage does not exist as to why you are placing members of the Lords at potential security risk.
  5. Technical details as to why the live stream was cut inside House of Lords.

This request is made under the GDPR (General Data Protection Regulation) Act, which obligates you to respond appropriately to such legal inquiries.

I make this inquiry to the European Court of Human Rights, Strasbourg Human Rights Application 4943, served by WRIT 18/11/2024 10:55.

I appreciate your clarity and transparency on this matter and look forward to your timely response.

Kind regards,

Kind Regards
Mr. Martin Newbold

Gods children are not for sale

Class action needed 500 plus cases to bring Truth justice and accountability for our children in the corrupt care system. Anyone who remembers the England Post Office Horizon scandal will know we need 500+ names to get A class, collective or group action is a claim in which the court awards permission to an individual or individuals to bring similarly placed claims in a single case. Collective actions are an efficient way of dealing where there are a huge number of claimants suing a large corporation or social services under a similar set of facts.

  • This is why we all stood strong and fought for all our children.
  • Now the only consideration must be to They came for our Children and they are FINISHED.
