Subject: Formal Claim of Negligence and Request for International Review and ‘Wrongful’ Separation, (ref: TOF-2032-2024) (ref: 18971405)
I am writing to address the deeply concerning actions taken by East Sussex County Council regarding the wrongful detention of my daughter under the Deprivation of Liberty Safeguards (DoLS). It is my firm belief that this DoLS has been used as a means to exploit her in what amounts to modern slavery, directly resulting from your negligence and misuse of jurisdictional discretion.
During this 13-year period of DoLS, only one Looked After Child (LAC) review has been conducted, which is an appalling neglect of duty. Moreover, there has been no contact facilitated, despite a PO Box being available for communication. To compound these violations, my daughter has been illegally placed in Northern Ireland, more than 50 miles away from her parental home, further exacerbating the distress and breach of her rights. Your actions have involved coercive control, in direct violation of Article 6 of the European Convention on Human Rights. This article guarantees the right to a fair trial, which has clearly been breached in this case.
I would point out this situation has been heavily criticized by England’s most senior family judge, who described it as a “crisis.” His concerns are echoed by the children’s commissioner for England, who has called the impact of these orders “absolutely horrific” and a “national scandal.” I would point out that it has been widely reported in the Irish Times that the care system in Northern Ireland is “NOT FIT FOR USE”.
I formally address serious concerns regarding the actions taken by East Sussex County Council, particularly in relation to the wrongful separation of my family. I would like to draw your attention to Regulation 8(1), which explicitly states that an authority cannot dispense with any complaint pertaining to a statutory duty that the local authority may have towards an individual.
Failing to adhere to this regulation creates a perverse incentive to entangle individuals in proceedings, thereby neglecting your statutory duties. There is a significant risk that your duties may be neglected during these proceedings, which could have dire consequences.
Furthermore, I must highlight the physical violence my family has endured due to the improper use of the Crown Prosecution Service (CPS). I ask you to consider the conditions under which a judge might lose immunity. Specifically, when a judge acts without jurisdiction, there is no discretion, as discretion is incidental to jurisdiction. When an officer acts entirely without jurisdiction or fails to comply with jurisdictional requirements, they may be held civilly liable for abuse of process, even if the decision was made in good faith but lacked jurisdiction.This principle extends to CPS workers. When a CPS worker submits an affidavit of truth in court, they are required to have firsthand knowledge of the events leading to the removal of children. This affidavit is submitted under the penalty of perjury. However, it is impossible for a CPS worker to have firsthand knowledge of all the events, which means that the CPS worker may be committing fraud upon the court by submitting such an affidavit.
These actions not only represent a gross miscarriage of justice but also raise serious concerns about the ongoing treatment and care provided by East Sussex County Council. The systematic failures and lack of oversight in this case are unacceptable, and I am formally claiming negligence.
Given the gravity of these issues, I am formally claiming negligence and requesting an international review of this matter. I urge East Sussex County Council to take immediate and transparent action to address these concerns, ensuring that the legal and ethical standards are upheld.
